Abstract

إن لموضوع النسب أھمیة بالغة في الأحكام الفقھیة والقانونیة،إذ یترتب على ثبوته جملة من الآثارالشرعیة والتشریعیة، لذلك فھو یحتاج إلى الكثیر من التریث، ومن أساسیات معرفة النسب تحدید طرق إثباته وھو ما تم معالجته في ھذه المذكرة إذ تعتبر ھذه الآلیات مقبولة شرعا وقانونا التي یلجأ إلیھا أطراف النزاع للإقناع وتنقسم إلى قسمین من طبیعتھا: منشئة بكل طریق یؤدي إلى الولادة، وكاشفة بكل طریق یؤدي إلى الإظھار والبیان. كما أن المشرع نظم جل ھذه الطرق في الفصل الخامس من الباب الأول للكتاب الأول من قانون الأسرة الجزائري تحت عنوان '' النسب''.

The subject of lineage is of great importance in jurisprudence and legal rulings, as its proof entails a number of legal and legislative effects, so it needs a lot of patience, and one of the basics of knowing lineage is determining the methods of proving it, which is what has been dealt with in this note, as these mechanisms are considered legally and legally acceptable.
