أثر اتفاقية سيداو على قانون الأسرة الجزائري

Abstract

يتلخص موضوع هذا البحث في دراسة مدى تأثير اتفاقية القضاء على جميعأشكال التمييز ضد المرأة المعروفة إختصارا ب سيداو على قانون الأسرة الجزائريوالتي دخلت حيز التنفيذ سنة 1981 والتي تهدف أساسا إلى حماية حقوق المرأة عن طريق تحقيق مبدأ المساواةالمطلقة بين الجنسين وذلك من خلال إلزام الدول بإلغاء كافة الأحكام التمييزية ضد المرأة في تشريعاتها الداخلية. وقد صادقت الجزائر على هذه الإتفاقية سنة 1996. ومن أجل ملائمة التشريعات الوطنية مع الإتفاقية قام المشرع بجملة من التعديلات على قانون الأسرة بموجب الأمر 05-02 المؤرخ في 27 فيفري 2005.والذي كرس مبدأ المساواة بين الجنسين والتي هي من أهم مبادئ إتفاقية سيداو. The subject of this research is to study the impact of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) on the Algerian family code, which entered into force in 1981, which aims mainly to protect women's rights by achieving the principle of absolute equality between the sexes by obliging countries to abolish all discriminatory provisions against women in their domestic legislation. Algeria ratified the Convention in 1996. In order to harmonize national legislation with the Convention, the legislator made a series of amendments to the Family Code by Ordinance No. 05-02 of 27 February 2005. Which enshrined the principle of gender equality, which is one of the most important principles of the CEDAW Convention.
