الحق في الإعلام الإداري في القانون الجزائري

Abstract

الحق في المعلومات الإدارية يعني حق المواطن في الحصول على المعلومات. وقد حظي هذا الحق بدعم كبير في العديد من الدول من خلال اعتماده في الاتفاقيات والمعاهدات الدولية. وتتبنى العديد من الدول هذا الحق بشكل متزايد ضمن دساتيرها وتشريعاتها. إلا أن هذا الحق في الجزائر لم يحظَ بالحماية والاعتراف الدستوري الكافيين، إذ لم يُسنّ قانون ينظم هذا الحق. المعلومات الإدارية هي حق المواطن في الوصول إلى الوثائق الإدارية. كما أنها تُسهم في تحسين الخدمة العامة التي تُعتبر حقًا من حقوق الإنسان، وتسعى إلى تقديم خدمات أفضل للمواطنين وتحسين علاقتهم بالإدارة من خلال الإدارة الإلكترونية. إلا أن هذا الحق له قيود وحدود على بعض المعلومات والوثائق التي لا يمكن الوصول إليها لكونها سرية وهامة. في النهاية، لا تزال المعلومات الإدارية تفتقر إلى بعض الآليات الفعالة التي تُركز على وصول المواطنين إلى المعلومات، وخاصة آليات التواصل بين الإدارة والمواطن.

The right to administrative information means a citizen’s right to information. This right has received considerable support in many states through its adoption in international conventions and treaties. Many states are increasingly adopting this right within their constitutions and legislation. However، this right in Algeria has been subject to a lack of protection and recognition in the constitution، as Algerian legislation has not enacted a law governing this right. Administrative information is the citizen’s right to access administrative documents. It also contributed to improving the public service which is considered a human right and seeks to provide better services to citizens and improve the citizen’s relationship with the administration through e-administration. However، this right has limitations and restrictions on certain information and documents that cannot be accessed as confidential and important. In the end، administrative information still lacks some effective mechanisms focusing on citizens’ access to information، especially the communication mechanisms between the administration and the citizen.
